Most guides to 55+ living are written from brochures. This one was written from recorded documents.

Building the Utah 55+ registry meant pulling declarations, plats, city ordinances, county parcel records and MLS project restrictions on 100 communities across nine counties. That work turned up things that are not in any brochure, and that change what you are actually buying.

What is inside

The three things called “55+.” Age-restricted, age-qualified and active adult are legally different, and which one you buy decides who can live with you, whether a younger spouse can stay, and how many buyers you can sell to later. Of the 83 Utah communities we verified, 64 percent are age-qualified, only 24 percent are truly age-restricted, and 12 percent have no enforceable age rule at all.

The trap that catches the most buyers. The name on the sign is often not the name with the age covenant. Large master-planned communities frequently contain a small 55+ pod while the master itself is all ages, and both are sold under the same name. We found communities where fewer than a fifth of the lots actually carry the age covenant, and a single marketing name spanning four separate recorded associations.

Why “single-level living” is frequently untrue. It was common to find a quarter to a half of the homes in a phase carrying a second above-grade floor while the community advertised single-level living. The usual culprit is an optional bonus room over the garage, which is a second story with stairs.

What it really costs. Verified dues ran from $60 to $445 a month, and the headline number tells you almost nothing. At the bottom of that range, dues can cover roads and sidewalks and nothing else, with the roof, windows and fences left to the owner. Higher up, they can include a clubhouse, pool, gym, internet, or even your heat. Plus the closing fee almost nobody discloses, which ranges from $100 to over $2,500.

Where these deals quietly die. Condominium project approval, expired FHA status, non-warrantable projects, manufactured-home lending, and land lease versus deeded lot.

Rules that end the conversation. Leasing prohibited outright. Pets capped at 12 pounds. Nobody under 18 permitted to reside. Master insurance deductibles reaching $25,000. Boards able to levy on the order of $1,200 per home without an owner vote.
